APPLICABILITY

These Terms and Conditions of Sale apply to all products sold through SVE, LLC d.b.a. SteamEngineWorks.com (“SEW”) to all purchasers of such products (“Customers”). These terms and conditions may not be altered in any way by any oral or other written agreement. SEW’s receipt of a deposit and/or payment on an order constitutes Customer’s agreement to these Terms and Conditions of Sale. Orders will not be initiated until SEW receives either (1) (a) the signed acknowledgment or (b) acceptance online during the check-out process and (2) the appropriate deposit from Customer.

SEW will provide you with information regarding the status of your order and will notify you when the product(s) is/are ready for delivery. Within five (5) business days of notification of delivery, you must pay the full balance owed to SEW. No shipping shall occur until the full balance is paid in full. If the balance is not paid within thirty (30) days from the date of notice of shipment, then interest shall accrue at 1.5% per month, and SEW shall have a security interest in the product(s) and may sell them to another customer after 90 days to mitigate its damages and recover the balance owed.

Estimated lead time and shipping date is based on SEW’s production timeline.

ALL SALES ARE FINAL

As soon as you place your order, SEW begins the manufacturing process for those items. Therefore, we are not able to cancel orders or accept returns.

Remember, SEW staff are happy to assist you with the ordering process.

No return or repair may be made without the express written authorization of SEW.

PRICES AND PAYMENT

Prices do not include actual shipping/packing related charges which are determined based on your location; all such charges are the responsibility of Customer to be paid prior to receipt of goods.

Any additional delivery fees, when not included in the SEW invoice, are due to the delivery company at the time of delivery.

SHIPPING AND DELIVERY

SEW products will ship via express freight carrier. Most carriers schedule deliveries Monday through Friday between the hours of 9:00 a.m. and 5:00 p.m. Freight companies may contact you a few days prior to the delivery to schedule a delivery date and time frame (typically 2-4 hour blocks) that works for you. If you need to reschedule the delivery with the carrier, please contact them as soon as possible so as not to incur any charges for missed delivery appointments. Please do not arrange for the products(s) to be delivered when no one is available to receive them.

While we do our utmost to ensure your order arrives in a timely manner and in perfect condition, there are some things that are beyond our control. We would like to claim that damages do not occur during transit, but unfortunately that may not always the case. Our freight carriers handle your pieces with great care, but it is important to understand that from time to time damages do occur. We take great care in packaging our products for shipping. Please notify SEW immediately if any damages have occurred in transit. We will work with you, as described in the Warranty section below, to address damages that occur during shipping.

SEW is not responsible for delays in shipment beyond its control, including, but not limited to, force majeure events, material shortages and labor or transit strikes. SEW will use its best efforts to notify Customer in the event of such delays. Any quoted delivery dates are best estimates from the carrier. Completed products ready for delivery or shipping must be moved to Customer’s delivery or shipping location within 5 business days after completion. Merchandise, which is not so moved, may be transferred to a commercial warehouse for storage; Customer will be liable for all cost and expenses incurred thereby, including any and all related shipping and delivery costs. SEW may elect to store the merchandise, in which event Customer shall be required to pay SEW $20.00 per day. Payment in full must be made before we will ship your product. SEW retains title to all merchandise until fully paid for by Customer. Customer agrees to pay for all cost and expenses incurred in collecting unpaid accounts, including, but not limited to, collection agency fees, attorneys’ fees and court costs.

SEW does everything possible to assure a smooth and prompt delivery of your order and custom items. However, be aware and consider that there are circumstances out of our control that may arise and result in a delay in the production or delivery of your items. We do our best to give accurate lead times. We welcome your inquiries as the estimated delivery time approaches and we can follow up to give you a more specific idea of your ship date at that time. We know you’ll enjoy the product you ordered!

INSTALLATION

Customer assumes all responsibility for proper installation of their engine(s) or other products. SEW shall not be responsible in any manner for damage to the product, any property or any individual resulting from its use, installation, misuse, mishandling, or for any other reason.

RETURNS AND CANCELLATIONS

SEW will not accept cancellations or returns without its prior written permission. Unauthorized returns will be refused and returned freight collect. SEW is under no obligation to authorize a return or cancellation and Customer acknowledges that all sales are final. Any returns or cancellations are at the sole discretion of SEW.

TAX

Applicable sales tax will be charged on all orders to be delivered in the State of Texas. Taxes collected in other states vary by vendor and will be invoiced accordingly.

LIMITED WARRANTY

What This Warranty Covers
This warranty covers all parts, labor, and certain related shipping charges, and applies to all products purchased from SteamEngineWorks.com. We will repair any manufactured defect within one-year of the date we ship the engine to you. We will also repair any damage that occurs during shipping. We will pay shipping charges for you to send your engine to us, as well as shipping charges incurred to return your engine to you.

What This Warranty Does Not Cover

This warranty does not cover any problems caused by: (1) abuse or misuse (including, but not limited to, operating an engine at unsafe speeds exceeding the maximum speed stated in the operating manual or making even minor modifications to the engine or any part of the engine), as determined by SteamEngineWorks.com in its sole discretion, or (2) an act of God (such as a flood) . Also, consequential and incidental damages are not recoverable under this warranty. Some states do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you.

How Long the Warranty Lasts
The coverage of this warranty lasts for one (1) year from the date we ship the engine to you.

How To Get Service
If you are not satisfied that your engine is in good working order during the warranty period, simply send us an email to info@steamengineworks.com or call us at 1-800-874-8340 between 9:00 a.m. and 4:30 p.m. central time to discuss with a service representative. We will work with you to make any repairs or adjustments at no cost to you.

How State Law Applies
This warranty gives you specific legal rights, and you may also have other rights which vary from state to state.

SITE POLICIES, MODIFICATION AND SEVERABILITY

Please review our other policies, such as our Privacy Policy and Terms of Use, all of which are incorporated herein by this reference and are posted on the Site (collectively, the “Policies”). These Policies also govern your visit to the Site. We reserve the right to make changes to the Site, Policies, and these Terms and Conditions of Sale at any time. If any of these conditions shall be deemed invalid, void, or for any reason unenforceable, that condition shall be deemed severable and shall not affect the validity and enforceability of any remaining condition.
